What is the Motor Vehicle Act, 1988?

The Indian Motor Vehicles Act was passed in the year 1988 by Parliament of India and regulates almost all the aspects of road transport vehicles. This Motor Vehicle Act provides detailed provision on licensing of the drivers and conductors, registration of motor vehicles, the provision on controlling their permits, traffic regulation, related insurance, liabilities, and penalties.

The Motor Vehicle Act, 1988 majorly tells that no vehicle can be driven without being registered under this act and no one can drive a vehicle without a valid driving license. The motor vehicle act provides a provision for compensation for those people who are on the road and can get affected by drivers of these motor vehicles.

What is the Motor Vehicle (Amendment) Act, 2019?

The Standing Committee on Road Safety & Transport had observed that the majority of road accident being caused due to the driver’s fault may be erroneous. They also observed that the other reasons for an accident include fault of drivers of other vehicles, defect in condition of a motor vehicle, fault of pedestrian, weather conditions, faulty road engineering, etc. Based on this report, the Ministry of Road Transport & Highway proposes the Motor Vehicle Amendment Bill 2019 in Parliament which is passed in both houses – Rajya Sabha and Lok Sabha. Mr. Ramnath Kovind, President of India signed this bill on August 9, 2019, and Motor Vehicle Amendment Act, 2019 has come into effect from September 1, 2019.

Imprisonment of 6 months to 1 year and/or fine of ₹ 1000 – ₹ 5000 for first offense and imprisonment up to 2 years and/or fine up to ₹ 10000 for second offense.

Drunken Driving

₹ 2000

Imprisonment up to 6 months and/or fine up to ₹ 10000 for first offense and imprisonment up to 2 years and/or fine of ₹ 15000 for second offense.

Driving when mentally or physically unfit to drive for

200 for first offense,  500 for second/subsequent offense

First offense – 1000 and second/subsequent offense – 2000

Offences relating to accident

Imprisonment of up to 6 months and/or fine up to 5000 for first offense and imprisonment up to 1 year and/or fine up to 10000 for second offense.

Racing and speeding

Imprisonment of up to 1 month and/or fine up to 500 for first offense and imprisonment up to 1month and/or fine up to 10000 for second offense.

Driving uninsured vehicle

Fine of 1000 and/or punishment up to 3 months

 

2000 and/or imprisonment up to 3 months for the first offense and fine of 4000 and/or imprisonment up to 3 months for the second offense.

Taking a vehicle without lawful authority and seizing motor vehicle by force
